1. Nature of Engagement

HomesPI provides non-invasive building inspection services and associated property condition reporting for the purpose of pre-purchase and general property due diligence.

All inspections and reports are prepared in accordance with generally accepted residential inspection practice and are based solely on observations made at the time of inspection.

The service is strictly limited to visual, non-destructive assessment of accessible building elements and does not constitute:

  • structural engineering certification

  • architectural design services

  • building compliance certification

  • valuation services

  • legal advice

  • or financial advice

All opinions expressed are professional observations based on visible conditions at the time of inspection.

2. Scope and Limitations of Inspection

The inspection is limited to reasonably accessible and visible areas only at the time of attendance.

Unless expressly stated within the report, no assessment is made of:

  • concealed building elements

  • internal wall, floor, or ceiling cavities

  • sub-structural conditions

  • invasive moisture detection

  • asbestos or hazardous material identification

  • compliance with building consent conditions

  • engineering design adequacy

The Client acknowledges that conditions may exist which are not visible, accessible, or detectable within the scope of a non-invasive inspection.

3. Repair Cost Guidance (Indicative Only)

Where included, any repair cost allowances or estimates are provided strictly as indicative, order-of-magnitude guidance only, intended to assist the Client in understanding potential relative exposure based on observed conditions at the time of inspection.

Such allowances are not and must not be construed as:

  • quotations or tenders

  • quantity surveying services

  • engineering costings

  • scope of works documentation

  • fixed-price estimates

  • or guarantees of repair cost outcomes

All cost guidance is provided for general informational purposes only and reflects broad industry knowledge and observed market conditions at the time of reporting.

The inspection is non-invasive and limited to visually accessible areas only. No destructive testing, intrusive investigation, specialist testing, or concealed condition assessment has been undertaken unless expressly stated.

Actual repair costs may vary materially due to factors including, without limitation:

  • contractor pricing variability

  • regional and market fluctuations

  • access and staging constraints

  • material availability and specification changes

  • compliance, consent, or regulatory requirements

  • engineering or specialist design inputs

  • latent or concealed defects

  • hazardous materials (including asbestos)

  • weather or site conditions

  • variations in scope upon further investigation

Cost allowances must not be relied upon as a representation, warranty, or guarantee of actual remediation cost outcomes.

The Client is expressly advised to obtain independent quotations and specialist advice from appropriately qualified contractors, engineers, or consultants prior to any purchase decision, contractual commitment, or commencement of remedial works.

To the maximum extent permitted by law, HomesPI accepts no liability for any loss, damage, cost escalation, or consequential impact arising from reliance upon indicative cost guidance or its use in decision-making processes.

4. Reliance and Intended Use

The report is prepared solely for the named Client and for the specific purpose of property due diligence in connection with a potential acquisition or assessment of condition.

The report must not be relied upon by any third party without prior written consent.

The report constitutes an informational and advisory document only and must not be used as the sole basis for:

  • purchase negotiations or price adjustments

  • financial or investment decisions

  • contractual commitments

  • legal determinations

Any reliance placed upon the report by third parties is strictly at their own risk.

5. Limitation of Liability

To the maximum extent permitted by law, HomesPI shall not be liable for any:

  • indirect, consequential, or special loss or damage

  • financial loss, loss of opportunity, or transactional loss

  • reliance on opinions, observations, or indicative cost guidance

  • failure to identify concealed or inaccessible defects

  • variations between estimated and actual repair costs

In all circumstances, HomesPI’s total aggregate liability, whether in contract, tort (including negligence), or otherwise, is limited to the total fee paid for the inspection service giving rise to the claim.

6. Third-Party Information and Market Variability

Any references to repair methods, materials, or costs are based on general industry experience and observed market conditions only.

HomesPI does not warrant or guarantee:

  • contractor availability

  • contractor pricing accuracy

  • third-party workmanship

  • future market conditions

  • or supplier pricing stability

7. Client Acknowledgement and Responsibility

The Client acknowledges that:

  • a building inspection is inherently limited in scope and certainty

  • additional specialist reports may be required depending on property type or findings

  • all final purchase, negotiation, and financial decisions are made independently by the Client

  • the report forms only one component of the Client’s due diligence process

8. No Warranty

No warranty or guarantee is provided as to:

  • the future condition or performance of the property

  • the completeness or absolute accuracy of observations

  • the correctness of indicative cost allowances

  • or the discovery of all defects or building issues

9. Governing Law

These Terms are governed by the laws of New Zealand.
